    OK guys in a nutshell my niece is in serious ****! She was going to use EURODEBT CMC until I stopped her, they wanted £400 for the first 4 months to cover their costs before they began the programme if you like of paying her creditors!

    It is a CREDIT card and not a Charge card.

    This is the first one of many. Other threads to follow when I get the info from her! Like pulling teeeth!!

    Debt is £6,512.85 which has now been passed to RMA. She did not receive a default notice first so she says!!!!

    I know I have been on this site for a long time but have no experience with DCA'S at all.

    What's the next step please

    Hi hun

    The first thing I'd do is send the FULL CCA letter in post #2 on Curly's guide Legal Beagles.

    In fact I'd do this for all your nieces debts and then you can see who has got the right paperwork and who hasn't, then the ones that havn't can get referred back to the original creditors.

    Whilst thats being done you can then stick everything into dispute using the letters again on Curly's guide post #6, there's various versions there for all situations.

    Then next (yes I know its going to be like pulling teeth) but get your niece to supply you with all details of all debts that she owes, and get her to fill in an Income and Expenditure sheet, then you are ready to make pro rata offers to pay when the time comes.

    Lastly don't panic, they can't hang her for it, there's loads of people out there in debt and you are now going to take control of her life for her and get her on the road to recovery, slow though it may seem, but well worth it in the end.

      Right then my turn.
      RMA and their "parent" NCO ignore statute law.
      By all means fire off the FULL CCA, but get the telephone numbers changed.
      RMA claim they are a telephone based DCA and as such call numerous times a day.
      They ONLY way I could stop them was a number change.
      Either that or get BT Choose To Refuse service and block their numbers.

        Thanks both, will do CCA.

        Curly just as well her phone line is cut off! They are relying on mobiles at the moment !

        Are RMA Amex in-house collections department?

                And RMA's figures do not tally up with her last Amex statement!!!!

                  Guys

                  Had dealings with RMA ******s about a year ago on a corporate amex card.
                  In a nutshell ***king useless. Got a payment plan sorted out by email which I squeezed down to 50 pence a week, then lo and behold it reapperared with a solicitor in Kent (Brachers)

                  Summation: relax , your dealing with asswipes as regards that outfit.

                    OK I sent off the letter saying can't afford the payments blah blah with an IE sheet to 3 CC companies. One has played ball and accepted the payment she can afford and no more interest will be added for the time being.

                    However nothing from Amex at all. Two rude letters from RMA - they ignored the prove it letter.

                    And yesterday my niece got a card in the post with RMA headed at the top but a calling time from G Fearn from NCO Europe for next Thursday????
                    So does that mean it has now been passed to NCO Europe!?

                    What to do next please

                        It may seem like a strange suggestion but what so wrong about honouring the credit agreement you signed. At the end of ther day, it was because you signed the agrement that these companies provide you with finance to spend on what you want. Just a thought.....

                          It may seem like a strange suggestion but what so wrong about DCA following the guidelines as set out by the OFT, and at the end of the day if a credit agreement is flawed why should you not question it, could be excessive interest, PPI, etc.

                          Perhaps if these companies did not throw money at people who could ill afford it and do the proper credit checks then they would not get into this situation in the first place.

                          Isn't that why the Country is in the state it is in now though the banks just doing that!!!

                          Banks and Credit Card companies have been fleecing the public for years so why not give them a taste of their own medicine after all we own most of them.

                          Just a thought.....
