  • Just Joined the Cabot Gang

    Hi guys

    Long time no hear, I have been really busy with stuff.

    Anyway, this morning I got a letter from Cabot, seems that Capital One have sold the alledged debt that they can't prove to Cabot and Cabot now want me to get in touch to arrange payments and they are going to start recording things on my credit file in 60 days.

    Now I sent Crap One a CCA request over a year ago and they could never come back with the agreement, they sent people round, plagued me with phone calls, (to the extent that I changed my phone number) and when it was pointed out by Power 2 Search that I had requested a CCA, and they had defaulted on that, they came back and said that they needed my signature. I replied telling them that they were quite happy to demand money without proving they had the right person blah blah blah.

    so anyway, now I need to know which letter I send to Cabot and how I deal with them.

    So over to you experts.....

    Have they bothered to send a Notice of Assignment? Did Cap 1 ever record a default on your credit file?

      I am not sure if Crap One did, they may have done as they kept blustering about it, but they never wrote and told me they had.

      On the back of the welcome to Cabot letter (I also got a goodbye from CO), it states under the heading of Important Information,

      1. This letter acts as Notice of Assignment of your account to Cabot Financial (UK) Limited and as such should be kept by you at all times (actual word for word text)

      2. Cabot Financial (UK) Limited is the legal owner of the account referenced overleaf. (actual word for word text)

      3. Telling me they are part of the Cabot Financial Group

      4. Cabot Financial (Europe) Limited is the data controller and how i have the right to access the info they have for a price of £10 blah blah and that they would need eveidence of my identity like a passport or driving licence.

      5. As the Group's servicing company, they are entitled to receive payment of the full amount outstanding.

      6. interest may be accruing blah blah

      7. if i want to take independant legal advice do it asap

      8, where to send all correspondence

      9. list of accepted payment methods

      10. who to make cheques payable to.

      then there is gumph about my personal information and how they uses it (DPA etc), address for yhe 3 credit reference agencies (Experian, Equifax and Callcredit). some stuff about crime prevention and money laundering, and then stuff about email (recording email addresses etc) phone calls being recorded and then responsibilty for customer confidentiallity.

        I'd tend to SAR them anyway just for the fun of it. When they ask for proof of ID, write back and tell them that since they cannot accept that you are who you say you are, they must be chasing the wrong address and so you can see no good reason to continue any further dialogue. And can you please have your tenner back.
