    Hello ,
    I have received a letter from a Debt agency , stating I owe £1800.00 from 1998 on a Barclays Visa Card . Firstly, i currently have a Barclays visa card (limit £550.) and it's the only one I've ever had from Barclays .
    I did have a Bank of Scotland Visa Credit card about 12 years ago but am possitive it was closed and paid up - no outstanding amounts .
    Whan I contacted the Debt agency she stated that my date of birth was the same as she held ( I told her 1st what my date of birthwas - foolish now I realise ! )
    She has said she will send me a copy of the Credit card agreement so I can see if it is in fact my signature . If not obviously will go to police and report fraud . If it is in fact the Bank of Scotland Visa card from 12 years ago , can this company still contact me after all these years - this would be the first time I'd heard of it , Is there not an 8 year rule where these things are written off ? and If it turns out to be Fraud , how likely is it that the Police will find who-ever applied for a card in my name from 12 years ago , I can't even remeber the full names of people I shared flats with ??

    It's 6 years, not 8. In England anyway. 5 years in Scotland.

    Assuming of course, you have neither made payment of any kind, nor acknowledged the debt IN WRITING, in all that time.

    So assuming you now have a Barclaycard, it seems inconceivable that you would have manged that with a default on your credit file.

    Which is what you should do too. Get a copy of your credit file and see if there is any mention of this on there.

    Sounds likely to be statute barred. In which case you can quite happily tell them to go play with themselves. Which DCA is it, by the way?

        Smells like a Thames Credit action to me.
        They told me that they could enforce any debt for TWENTY years !!!!!

              Well if it is them, they are pretty easy to get rid of.

              Mind you thinking again, it could be our old friends Cabot, they tend to deal with Barclaycard nowadays.

                No need to mess around with it though is there? If you are positive its not your debt, then don't acknowledge it, especially not in writing, as has already been said in previous posts. Even if it is your debt, which the onus would be on them to prove, if there's been nothing for over 6 years its statute barred anyway, which has also already been said.
