    Hello, I recently was passed on a letter from my mother about a letter she recieved for me coming from Lowell Portfolio. The letter mentioned that they had recently purchased a debt from HBOS in recent weeks and were asking for a payment of £1,700. In 2007 my bank account was frauded, when cheque's started bouncing out of my account. It wasn't the first time this had happened, and due to me not owning a chequebook for my account, Halifax returned the stolen cash to my account. Months later this happened again, and this time Halifax failed to help me or investigate in fully what had gone on. I entered telephone discussions and even had a meeting at my local branch, to which a week later I recieved a template message basically calling me a liar, and demanding I payed off my debt. They also told me of two occasions a Chequebook had been sent to my house. However I never ordered...or recieved any of them. I went to my local Citizens Advice Bureau who contacted Halifax, and I hoped the situation would improve. It didn't though and I recieved another template letter a few weeks later. One thing I did fail to do was notify the Police, or keep any letters and correspondence I had between myself or the Halifax. By this time the debt had been passed on to a Scottish Debt Collecting agency (I cannot recall the name) and I discussed with them my problem, and also the fact that I was a student with very small income. Halifax or the first collection agency refused to help me, so being fearful of a backlash I walked away from the account when I moved out of a friends house. In a torrid year which also the majority of my Identification go missing in the post, It took me a while to get back on my feet, and had to rely on my money going through a friends account. In June I opended an account with Lloyds TSB, who strangely enough offered me a top range account, to which I assumed that the fraudulent debt forced on me had either been wiped out or froze. I set up my bank account under my mothers address as I was in the middle of moving into another accomodation, and then suddenly this letter comes from Lowell Portfolio to my mothers house. I am under the assumption that I must of suddenly appeared ona database somewhere, and as my HBOS account was registered at my mothers house 6 years ago, they have taken it upon themselves, or assumed that its the same person.

    After reading some of the comments on the Internet , I am pretty horrified. I am an honest person, and Ive been brought up to pay my own way, I am now pretty fearful I may be forced into paying a debt I really shouldn't be paying. I have been told to get a solicitor, but my job isn't great, and I really don't have many things to go on, other than my honesty. I have been worried that this debt may creep up on me, and maybe walking away from it wasn't the best idea, however I was NOT and WILL NOT be willing to pay a single penny for something I was completely innocent about. I have been advised not to contact Lowell and not to send them a penny, my mother (who happens to live in another City) has maintained that she will not telling them anything via phone apart from that I don't live here anymore. Is there any way I can get round this, anything I can do or say, I am not willing to acknowledge this as my debt, its fraud that was on my account, therefore I don't want to have to give away money that just isn't available. Lowell do not have my current address, nor my phone number, is there anyway I can deflect the chasers away from me? Its an odd request, but any help would be appreciated, as I really don't know what to do with the situation.

    Running away is not going to help. If the fraud was committed with cheques, then the bank will be able to produce them and you will be able to prove that they were not signed by you. That would appear to be the best course of action here.
