  • Moving home. Debt Unenforceable. Should I provide the DCA with my new address?

    Thanks to echat and others on this sub I successfully challenged Dryden Solicitors who were unable to provide a true copy of the CCA with the prescribed terms and have therefore stated that the debt is unenforceable. I had not had any correspondence with Drysden for quite some time until I received a letter stating Capquest has been appointed by Interum Popular as an administrator of the agreement. I have not responded to that letter which I presume is just notification that the debt has been sold? I will be moving home and I am wondering how I should handle this move. Should I just make sure the electoral roll / credit file is up to date with my new address once I move (checking my file regularly) or should I actively contact Capquest to notify them that I have moved? The debt will be statue barred in two years unless a CCJ is issued. I am scared that they will "magically find" a CCA and/or issue a CCJ to an old address but I also don't want to acknowledge the debt in any way or poke the bear and start harassment at my new home. What would you advise? Appreciate the help as always.

    You should notify them of your new address otherwise they could start a court action against you at your old address and win a CCJ against you by default if you didn't know about it. Creditors aren't obliged to check where you live before issuing proceedings, they can use the last known address you provided.

    Notifying a change of address is not an acknowledgement of debt. You can emphasise that by including an express statement saying that
