    Hi
    I'm having trouble with lowell asking for a vanquis credit we do not really know about as it was over 6 yrs old that's for sure.we receive letter dated 20/01/2025
    Anyway we sent a letter stating statute barred 1980 act and provide proof of debt within 21 days
    today my wife got an email,yes an email no written proof saying that the debt is not statue barred this is because litigation has already taken place on the account. They have also stated that a CCJ was held on this account dated 08/082016 which has now expired. They have given us 30 days to offer a payment plan

    Welcome to LB

    CCJ's don't expire, although they 'drop off' your credit file.

    The Creditor would have to return to Court to try and enforce it.

    They would need a 'very good' reason why they haven't acted in the 8 years that have passed.

    They are wasting their time.

    Update the thread if you get any meaningful documents from Lowells or the Court.

        You are just getting yourself in a 'pickle', wait to see what or if they actually do anything.

        There are times to be 'pro active', this isn't one of them. They know they need to go to Court to enforce the debt, the Court won't be interested as they've waited 8 years.

            Yes, because you've made contact, Lowell's office has gone into 'meltdown', what can we send etc.

                    New letter came this morning threatening if we dont get in touch by the 19th March they will send a FIELD AGENT from RESOLVECALL
                    is there anyway way we can rid lowell from pestering us ?

                      Resolvecall has no powers, the postperson has more. As stated in post 2, that's the position.
                      Lowell has to go to Court, to enforce the CCJ, the Court more then likely will say 'they waited to long'.
                      If Lovell could have done more, they would have done it by now.

                        Not sure how to update thread
                        anyway we have been fighting lowell for a while now not giving up and got some more info
                        Apparently the debt is from vanquish in 2013 and lowell took over it in 2014 and Aparently my wife set up a payment plan and continued until 2021 which she doesnt remember doing but has lowell account online with that information
                        we dont recognise the debt itself but somehow still went behind her back and next we knew she had ccj
                        any update to the rest of it resolvacall did call and I answered and ask for my wife and said not in but wrote a card in front of me as if to post anyway
                        after this we put in a letter of complaint in email to lowell and cc resolvacall and this is how i found out this etc apparent information
                        so we have tried ombudsman but unwilling to do anything unless lowell refer to them
                        Any ideas of how we can close this
                        Im sorry for such a long post and its driving me my wife's anxiety through the roof and I got diagnosed with Autism in 2022 not that has any relevance just put you guys in the picture a bit more
                        any help will be extremely welcome

                          They may have a CCJ, you need to check one actually exists, when did they get it?
                          They could try to enforce the Judgement, seems like they are 'minded' not to, as they have left it too long to enforce.
                          So they've sent Resolvecall. The following is 'relevant'.
