I am writing to seek your guidance regarding significant concerns about the handling of my disabled mother’s council tax account. She recently received two Notices of Enforcement from Excel Civil Enforcement, which have raised several issues that need urgent clarification and resolution.
The first Notice of Enforcement, dated 10/12/2024, arrived five days later than its stated date. It claimed an unpaid council tax amount of £196.05, including a £75 enforcement fee. However, her local Council Tax department had previously indicated an owed amount of only £39. I made a payment of £80 on her behalf, which covered the requested amount and the following month’s dues. Her council tax account is now up to date, with no further amounts due until mid-February 2025.
Despite this, a second Notice of Enforcement was received on 24/01/2025, again claiming £196.05 and including a £75 fee. Confusingly, the outstanding balance was later stated as £191.05. I requested clarification on how this figure was calculated, but no explanation has been provided. Additionally, the notice mentioned plans to attend the property to enforce a Liability Order, which would incur a £235 fee. To date, no Liability Order has been issued, nor has my mother received a county court summons or any related documentation.
This situation has caused considerable distress to my mother, who is a vulnerable individual with significant health issues and a history of domestic abuse. The lack of clear communication, inconsistent figures, and threats of enforcement have created unnecessary suffering.
I would greatly appreciate your assistance in addressing the following:
- Clarification on the legitimacy of the enforcement actions taken without a Liability Order or prior notification.
