I have had an issue with ACI ( perch capital ) and what other names they choose to use.. they have purchased a debt for £5000 from Lloyds bank which was always reported as fraud activity. Lloyds bank could never prove anything the debt was for a gambling website (I don’t gamble) the debt was in 2016 no payments have ever been made to the debt and I have always asked for proof that it was me which was never proved the account my bank was closed… so the debt is 8 years old.. they managed to get a Ccj in my name as well which is annoying. I have involved the financial ombudsman who have contacted me today saying they can not pursue perch capital as they are not FCA regulated but ACI are. It’s all so confusing they offered me £500 off the debt but again as I said it not my debt and I’m not accepting anything as then I’m accepting that it’s mine. It causing me extreme health issue I am only working part time and caring for a disabled child. This company just continue to threaten me constantly phone calls / house visits involving asking my disabled child questions about me . All on CCTV…I am at my wits end with the company I don’t know any else I can do other than bow down and pay them so they back off but then I would be admitting to something which isn’t mine. Any advice would be be much appreciated the courts are no help they just ask me to contact the debt company.

Hi SMMY0630
Welcome to LB
Send Lloyds a Subject Access Request, they have 30 days to provide all the data on the account.
https://legalbeagles.info/library/gu...ccess-request/
Hopefully you will get information showing that it was reported as a 'fraud'.
Was it reported to the 'police' at the time?
If ACI ( perch capital ) contact you send them the following, make sure you get Proof of Postage -
https://nationaldebtline.org/get-inf...iability-debt/
If they pursue the CCJ they have, you might have to ask the Court for a set aside (you may be able to apply for Legal Aid because of your income), then you can produce evidence that it was reported as a 'fraud' with Lloyds.

There is an article titled "What to do if you are harassed by creditors" at www.stepchange.org
You are clearly suffering from harassment and you should write to ACI to stop future frequent and persistent contact
The article provides info on what a creditor can and can't do. There are letter templates which can be downloaded
Perch should not be phoning you in the evenings nor speaking to your child about you or the debt

Regarding the following 'This company just continue to threaten me constantly phone calls / house visits involving asking my disabled child questions about me'.
Lodge a formal complaint with ACI (provide all the evidence you have), follow the complaints procedure on their website, once you receive their final response / Deadlock letter, if you still aren't happy, lodge a formal complaint with the FOS.
What you describe is against the FCA's Debt Collection Guidelines.

It’s been with the financial ombudsman where I have again been going round in circles. The debt owners are perch capital not aci however ACI are chasing the debt. The financial ombudsman said perch capital are unregulated so they can’t do anything about them. Aci are regulated so now I have made a formal complaint against them. The stress is unbelievable
