    How did you respond to the DCA - ie. is there a letter template on this site? I have an agreement with Egg and is exactly the same as your brothers and want to get rid of the persistant Moorcroft Debt Recovery.....

      There's probably a 'clause of jurisdiction' that states "this agreement/contract is subject to English Law" & even if passed to a Scottish company they would still have to chase you in the English Courts If they attempted to use the Scottish Courts when your domiciled in England then they would almost certainly fall foul of an EU ruling which stipulated that any such term requiring the consumer to travel to another distant town & I assume that also means country would be deemed unfair

        Well now I've moved house and relatively settled back on the offensive.
        I've had 3 "pay up" letters from Cabot and a "OC still looking".
        So time for a nice little get stuffed as what you have supplied is complete rubbish.
        I'll bundle the 3 accounts together so to slightly confuse them

        Also got a letter from JB, who have asked DLC for the agreement.
        I wish they'd make their collective minds up as to who is "servicing" this account..
        No matter more fun for me.

        Obviously I'm not going to inform them of my new address, I purchased 12 months redirect for that purpose..

          So other than a few letters from Cabot saying account on hold for 14 days for you to contact before it goes back to collections, all the others have burgered off. I guess they didn't have any legal claim to these any way

          So I now have a couple of options, but I'm in that frame of mind where I'm going to bin Cabot with a leg side spinner..

          Something along these lines I think

            OK here's my contribution, excuse the grammar. This is for your part not your brothers of course lol.

            If however you do decide to pursue me through the court system, I will be more than happy to counterclaim against you for not providing me with the proper paperwork to prove that any debt is owed. I will also be very willing to attend said court and explain to the court your excessive pursuance of a debt that is not lawfully enforceable, your bullying tactics and your inane inability to understand the basic rules of the CCA 1974. I therefore conclude that I would request that your claim be struck out and that I be awarded costs and compensation at a rate that I am yet to decide.

            If this WERE for your brother then I suggest the following.

            Please be aware that if I were awarded costs they would be as follows and not limited to:

            2 First class return airline tickets from Australia.
            Double FULL BOARD acommodation in Top Class Hotel nearby to the court
            Taxi Fares for all of the time in England
            ALL food and beverages paid for by yourselves

            Now taking ALL this into consideration, I respectfully suggest that you re-consider your tactics and stop this foolish pursuit of an UNENFORCEABLE debt and confirm in writing that this matter is now concluded.

            Or words to that affect, what do you think ?

                Why not compose it into a witty song?

                Give Willy Welly a ring and sing it to him. As a kind of Farewell Serenade, if you like. Although be aware his direct line from a year or so ago is now non operational. I can't imagine why.

                In fact, why don't we all put our thinking caps on, and come up with a Witty Ditty? Best effort wins a reduced settlement from Ken's Kentish Klowns.
