Re: CB gets some new "friends"

        Hi Curlyben,

Have you ever heard of RMA? ive been getting phone calls from them. I refused to give them my security details telling them that they had to tell me who they were, which they wouldnt do til I told them my security details. Then they said they'd call back! blah blah etc. Which I responded telling them they'd be breaking the law with persistent harrassing phone calls.

The thing is, I have meticulously paid my min payments every month until this month I CCA's them all (Barclaycard, MBNA and EGG). I stopped the Direct Debits to them but they were only due on the 18th and 28th. So surely they wouldnt start with a DCA already?

Any advice? on who these people are?

RMA, oh yes I have heard of them and a right pain in the bum they where as well.
I ended up changing my phone number due to the volume of their calls.

You could try the same citing telephone harassment.

Re: CB gets some new "friends"

well, they have a document, and that document is signed, they are doing alright if you ask me lol

only slight fly in the ointment is

they dont have an agreement, which complied with s61(1) CCA 1974, that when laid before you to be signed , all its terms were easily legible

nor it seems did they have a document in the prescribed form ( see S60 CCA and Reg 2 schedule 1 SI 1983/1553) containing as opposed to embodying the prescribed terms( see schedule 6 SI 1983/1553)

In a word, they are in trouble

so, time to seek declaratory relief i think pursuant to s142(1)

If you need any help on that, you know where to find me
