  • Statute Barred Debts Activity

With all this activity around statute barred debt happening I thought this was a good read. Things might be changing in July 24 under the Consumer Duty rules. Maybe that’s why DCAs are trying to get what they can.

Useful information, but as I understand it, there is no actual benefit to the consumer at present because the FCA has decided that currently it will not be attaching a private right of action against firms who are in breach of the Consumer Duty Principle. So in effect, the only recourse would be to complain to the FCA and that will usually do nothing unless there are repeated claims against a particular firm relating to the same breaches.

The FCA may then investigate, not that you will hear about it unless they decide to publish their investigation/action.
