  • 24 year old debt - Resolvecall letter out of the blue

    My partner took out a loan approximately 24 years ago for household improvements in his then marital home. A year later the marriage broke down and he left the home. He didn’t continue to pay the debt and was chased for a number of years and had bad credit etc etc.

    Last week he received a letter from Resolvecall stating that they’d been instructed on behalf of Intrum to recover the debt. My partner doesn’t have any paperwork relating to the debt and can’t remember the amount the loan was for. There has been no contact from the bank who gave him the loan for 15+ years if not more and his credit file is excellent.

    Can anyone advise whether they can chase a debt after so long if they haven’t made any attempt to contact him for so long?

    These people are just chancers. They buy up old debts that are unenforceable, paying just pennies in the £ for them, and hope to intimidate enough people into paying them some money to make it profitable for them. None of any money they collect goes to the original creditor, it's kept by the debt collectors who bought the debt.

    If your partner has paid nothing and has not acknowledged that he owes the debt in the last 6 years then the debt is statute barred and cannot be recovered in court. It sounds like he has had no contact with them for over 15 years so Resolvecall/Intrum know full well the debt is unforceable, they are just hoping your partner doesn't and will pay them something anyway.

    You can either ignore them entirely, in which case you will likely get a few more letters from them making various threats of legal action that they cannot actually carry out, or send them a Statute Barred letter.
