Hi, this may be slightly long winded but feel I need to put it all in order for understanding!

Last autumn various letters were sent addressed to the 'occupier' from a dubious firm called McKenzie Hall, seeking the 'occupier' to give up the whereabouts of a person, asking them to call and indicating it would be to their advantage. Well it would appear that McK H are renowned for these low tricks. I ignored these notes/letters and never heard anything more since, dont even know who the debt was against i.e. creditor.

Some 14 days ago a letter was received from Scotcall telling me to call them within 7 days or they would send the field agents round. So far no one has been round. Many moons ago due to personal circs, I defaulted on a debt, various attempts at paying in instalments fell by the wayside, can't even remember who the last DCA was, no longer have any paperwork relating to the the debt. I do however believe it has been 6 yrs since any contact either by means of a letter or payment but cannot be certain 100%.

My questions are
How do I establish if the debt is now statute barred
Do I make contact by letter with Scotcall

There are slight anomalies with the name of the co I took the loan with, they have written ** Money when I believe the co was called ** Financial, does this make a difference?

Any advice how to proceed gratefully received, am now reaching the 'frightened to answer the door stage' and deffo dont need the hassle now having finally gotten my 'life' back on track (last couple of debts being cleared by arrangement)

Will look at link, though I know the debt was taken out in 2000, its when I last 'contacted' them that is the issue, my understanding is the 6 yrs runs from last conact/payment as this is the admission to your ownership of hte debt?

Hi - Update

Thanks Enaid, have read the link, am going to dig out my trusty old printer and bash off the letter today. Did not realise they had to send me proof that I had made contact of some sort within the last 6 yrs! Doh.......teach me to read the whole thing! Bit like exams RTFQ lol

Feel a bit easier, though despise them knowing my address as I moved many years ago, think they may have found me through credit search as I recently checked my records, thankfully though cos found out my rat of an ex had me linked to an address I have never lived at!!!!!

Have you responded to these "lovely people" at all ??

To be honest this looks like a classic Mucky Hall phishing trip.
MH are well known for chasing the totally unenforceable and statute barred debts.
They have absolutely NO power to take enforcement action and simply rely on harassment and intimidation.

My advice would be to ignore them.
IF, and it's a big if, Snotcall do send an agent (they do sometimes) simply tell them that the debt is Statute Barred and you will NOT be making any form of payment at all.
Don't be drawn on a conversation and if they refuse to accept what you are saying then demand proof and ask them to leave.
