  • consumer credit agreement

Good afternoon all, I have been having a dispute with debt collectors regarding an alleged debt. I asked them for the original credit agreement and they have sent a photocopied one. However, I also requested the same from the bank and have recieved a reply from them stating that they cannot provide the credit agreement as they no longer hold any documentation, how can the debt collector have a copy when the bank cannot provide me with it. Many Thanks.

Maybe because the bank passed on a copy when it assigned the debt, before deleting its own records.
Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.

        When was the account opened?

Is it a 'reconstructed' agreement? So basically one they've made up from data they have available.

Just because they send you something, doesn't mean it's compliant.
