  • Resolve/Capquest

    Hi I’m after some advice

I've received a letter from a company called capquest regarding an old Debt with Barclays. Now I had some difficulties approx 20 years ago and I set up a debt payment plan through step change and paid the required payment until they confirmed it was all done.

I have not heard anything from anyone for 15 years then suddenly this letter comes through. I don’t even know if this is my debt. This letter came Friday then I have received another today from a company called resolve saying that as I haven’t replied to capquest letter they are now looking after the debt and will try to contact to arrange someone coming out to my house!

if this debt is mine it can only be a really old one. I know nothing is on my credit file for this and have no ccjs as I got a mortgage a couple of years ago and I have an excellent score on Experian and ClearScore with no negative marks.

I am confused should I contact them or just ignore it? I don’t want to incriminate myself if it’s an old old debt that is no longer enforceable or if it isn’t even for me

    Hi WorriedSam

    Welcome to LB

If no payment or acknowledgement of the debt in the last 6 years, then the debt is statute barred (this is providing there is no CCJ - check the register). You could send the following template, make sure you get Proof of Postage. Also print out a copy, place it in an envelope, if you get a visit, just hand it to the debt collector, that should send them away.

Even if there is a CCJ, the Court would need very good reasons why the Creditor has left it so late.
