Hello. I received a letter from Overdales stating they had taken over an old debt from Lowell’s. I sent a statute barred letter as I believed this was the case but have received letter today saying last payment on debt was 1/3/2018. It was a Capital One credit card. Long story short was unable to pay and defaulted.
i have made no payments since and not acknowledged debt since.
My circumstances now are that I am unable to work due to severe ill health. The debt is mine and my husband has no knowledge of the debt. He has dementia and would become very stressed by this situation. We are entirely dependent on benefits and can barely manage as it is. From what the letter says there is another year to go before debt is statute barred. What powers would Overdales have in terms of recovery as they are threatening further action but do not say what.
