      Re: DCA's letter quiz

I know it has to be blindingly obvious, but my brain cell has decided to go to sleep for the month!!

The only think i can think of is because it's been sent on behalf of an agent acting for an agent then they have no legal right to demand payment until you see proff of that legal right

If this was sent to me (and i;m sure I will be the receiver of a few of these very soon!!) I would send a letter stating that I do not recognise any debt to your company so send me the proof or bog off!!

If it's not that pleae tell me what it is!!! I'm not good at thrillers - I always read the back page first to see who did it!!!

        Re: DCA's letter quiz

OK I'll put you out of my misery on this one.

Nattie is right to ignore it and Fuzzy almost got the complete reason.

So BCW are acting as agent for Activ Kapital, another DCA, so they CANNOT take any legal action at all as the debt has not be assigned to them.
Now that coupled with the fact the AK purchase the RIGHTS but not the DUTIES, hence no absolute assignment, so they CANNOT take court action either !!!.

All told, they can huff and blow as much as they want, but they are happily ignored.

To give you more of the history.
This was "sold" to AK who then got Wescott on the case. Some payments where made to them, as I was green, until they defaulted on the CCA.
It was then passed back to AK who put Thames on to it (still part of the same group).
they postured for a while, but eventually gave up.
Now it's BCW's turn to be ignored..

IF they do file an N1 for this they will get a serious shafting from me, you can be rest assured of that and I will be selling tickets, as well as counterclaiming for a few years of harassment to boot, ala British Gas

        So there you go.
See you have been paying attention.
