  • After the CCJ

I had a CCJ issued mainly because I moved house and never received the papers. It was a legitimate debt so I hold my hands up to that but the CCJ was registered without me knowing. I took advice and was told that because it was a true debt there wasn’t much hope in contesting it, so I left it. I managed with it for the requisite 6 years and in June this year it dropped off my credit file. I now understand that it still hasn’t gone away. This morning I got a letter from PRA (?) chasing the debt. Bear in mind I had heard nothing from anyone about this since the CCJ so it has now been just shy of 7 years. Are they still within their rights to chase me for it when I’ve had not a peep about it from anywhere til now?

Yes, they can. Once judgment has been entered, the courts will assist the creditor with enforcing its rights to collect the judgment amount. There are some exceptions where the claimant wants to enforce the judgment by instructing bailiffs and taking control of goods for example, where they would need permission from the court after 6 years. Unless you can show that you are seriously prejudiced by the claimant enforcing its rights, the court will likely grant the enforcement order.

Options are to ignore the letter and hope it goes away, pay up or contest it (though I'm not sure what you would be contesting).
