    Have 1st supplied you with the Deed of Assignment without actually asking for it, hmm think not. ?!
    When a DCA says they have "bought" a debt NEVER believe them at all.

              Oh dear, see how easy it has been to get confused for me?

              I have just followed that link and I really think the whole thread should be deleted because it is mixed up with Cabot 1, which is Monument. Cabot 2 should be Barclays only. I am really sorry about the confusion. Not enough rest. :cry:

                  Then why are Cabot asking for an outstanding debt on a Barclay Bank a/c of £1036.58 AND a Monument CC debt of £3,335.25, as of letter fromFIRE dated 25th Feb 2009?? Why are both debts not amalagamated, so to speak? No wonder I am confused.

                  I think the questions above are rhetoric, really. What I need to do now is clarify with you the current situation in regard to both these Cabot a/cs...

                  I have sent off the no visitors to FIRE and the other letter requesting the copy of the agreement (with the PO for £1.00 & recorded delivery). Both relate to the Monument.CC.

                  I have done nothing in respect of the Barclays Bank a/c, of which I know nothing other than what I have been told by Cabot.

                  What should I do now?? I have a migrain so the screen is just becoming jagged lines. I am soooo thankful my migrains are not accompanied by pain.

                      I have received the following from HFC today.......

                      Thank you for your recent request for information that we hold about you.

                      We would be grateful if you would complete the enclosed form and forward it to the address indicated. A copy of your driving licence or valid passport is also required for verification purposes and we will then action the request upon receipt of the completed form.

                      Your cheque will not be cashed until we receive your response to our request.

                      Yours etc.,

                      SAR Team.

                      The form asks for my name, address, DOB and postcode.

                      Also (and this strikes me as silly really)....

                      "If possible, give the following details for each account you have held with HFC bank.
                      1)...Type of account
                      2)...Account Number
                      3)...Date account opened
                      4)...Branch/retailer where account was opened.

                      Please highlight which account (s) you would like information regarding.

                      Please indicate whether you have made telephone contact within the last 30 days and require a transcript of any conversation. YES/NO

                      Please sign here_______________________________ Date_________"
                      ( I do not think HFC have ever telephoned me, preferring to leave that kind of harassment to their DCA's and the last written correspondence from them was a letter in Jan 2007).

                      First of all, I know from what I have been told, and from what I have read here, that I NEVER sign anything for these people. Secondly, I do not drive and nor do I travel abroad and, as I have no desire to do either, why would I want to apply for such documentation? Thirdly, and probably most importantly, I have not the vaguest idea about the "Type of a/c; a/c No; Dates or Branch etc.," other than to say that I think it was a loan for a computer and a credit card I did not ask for back in November of 2003.

                      What is my next move here please?

                        Not to worry as this is their standard response for SAR requests, especially when you are requesting all information.
                        They are within their rights and DPA to request this information, so best to send it over to them really.
                        Once they have this, I must admit the SAR team are quite quick in responding.

                          OK, CB, I will do what I can to meet the request. However, as I have no proof of identity, such as a dl or passport, I take it I inform them that as my address has been good enough in the past it will have to do now. Also, dates and a/c No's are a non-starter I am afraid. Does that matter?

                            I'd give them a call and explain the problem.
                            Hopefully things like utility bills, etc should suffice.

                              Please highlight which account (s) you would like information regarding.
                              Inform them that you require ALL data held by them on you, not for just one specific account or type of data. You never know what else you may find out with a full pack of info.

                                I called and was told that a utility bill may suffice, and although one might think this a bit OTT, I have sent it anyway......

                                Dear Mr.,XXXX,

                                Thank you for your letter of 18th March 2009. There are a number of points I would like to clarify, so there can be no misunderstandings either now, or at a later date.

                                I am fully aware that you are perfectly within your rights to request certain information from me, in order to satisfy yourself as to my identity. I will always, whenever it is possible, and (I think), reasonable to do so, comply with such requests. Accordingly, please note the following……

                                1)……..May I be permitted to point out to you that not everyone drives or travels abroad? I do neither, ergo, I am not in possession of a driving licence or a passport. However, since your bank and it’s various DCA’s have seen fit to accept that my address has always been seen as sufficient proof of not only who I am, but also where I have lived for over 5 years, might I suggest it suffice for you too?

                                2)……..If the above is not acceptable, then I am quite willing to forward copies of, say, my telephone or water bill.

                                3)……..I am unable to complete the form you have sent because [a], see 1) above; , I am not going to sign anything and send it back to you and, [c], since I am disputing any & all debt to your bank, I would hardly be in a position to supply you with account numbers, dates, types of account or which branch/retailer dealt with the same. Locating and then supplying this information to me is quite clearly within your remit, as well as being in your bank’s best interests.

                                You say near the end of your letter:
                                “Please highlight which account(s) you would like information regarding”.

                                Aside from the points raised in 3), [c] above, I would draw your attention to my letter of 2nd March 2009, specifically paragraph two, and I quote:

                                Accordingly, kindly provide full and complete copies of any and all data you hold which relates to me and my entire history with your company.”
                                [b]
                                Paragraph four lists some, but not all the information I require from you. In order to save me the trouble of typing it all over again, I attach a copy for your convenience and reference, since I must assume you are not yet in possession of same.

                                I look forward to your full compliance with my request at your earliest convenience; certainly within the specified time frame referred to previously.
