    Hi,

    Over the last two years I have been chased by Lowell's and Overdales to pay an outstanding debt if £1,300. Despite explaining that they have the wrong guy (they do), I have been harassed with letters and later issued a court mitigation order.

    After a long letter from myself, providing evidence that I am the wrong guy that they seek, Overdales finally read this email properly and have decided to drop the case. They admitted that although I had sent information through previously, internal communication errors led to them still chasing this debt. They apologised and then said that feedback will be provided to the relevant department. Considering how much stress this has caused, anxiety, anger at being ignored, then being chased at my new home - this off the cuff apology isn't good enough.

    Is there any chance of obtaining compensation from the stress caused by this? Any money won would be given to charity.

    First thing to do is lodge a complaint with Overdales in writing. Summarize what's happened with dates, etc, explain the effect it has had on you, causing you stress etc. Tell them you want to be compensated for this. Explain that you are minded to take further action under the Protection from Harassment Act 1997. Depending on what they say, if you still aren't happy lodge a complaint with the FOS.

    Follow their complaints procedure.

    Also send them a SAR, they have 30 days to provide all the data on the account. That will help you if you lodge a complaint with the FOS.

      I agree. The best that I can think of is a claim for damages for harassment.
