  • Discontinuance Overdales

    Hi, I have received a letter saying Overdales wish to discontinue my case and the account is closed (which is great) I successfully got a CCJ set aside and defended my claim. Once the claim was set aside my defence was that I feel I am not liable for the debt, they’re not recognised and that Lowell (Overdales) do not own the debt. My downfall was that I’d paid over £2,000 to Overdales. Now it has been discontinued (in full) can I get this money back or is it lost to Lowell?

    Had you counterclaimed when submitting your defence that would have been a different story but the case was just discontinued so unless you now wish to sue for monies paid that’s the end of it.

      Thanks for replying. In reality is it worth it or am I better just cutting my losses?
