  • Resolvecall/mortimer clarke chasing a 10 year old ccj

    Hi,
    Hoping you can help me.
    In 2011 I lost everything, house, car, the lot.
    Was homeless for a while.

    Had lots of debt at this time, and essentially ran away. Was not a good time.

    In 2016, I had got better. Had a little flat. Got letters from mortimer clarke saying I owed £5000 and that they had a ccj.

    Sure enough, I had a ccj registered at my old, repossessed house for £4000, so I guess this is the same debt.

    After a couple of letters, they went quiet. Then in Sept 2017 I moved to my current home. Kept a post referral going until about May 2019.

    Started get letters at my new address from m/c in January this year. Same sort of letters as before.

    They told me they were going to involve Resolvecall. Had one letter from them, then a visit yesterday. I wasn't home so they left a card with my flatmate.

    I have used trust online search today. My last 3 addresses came up clean.

    I tried to speak to Northampton cbcc yesterday. They said the ccj case number I'd found in 2016 was incorrect, so not sure what to do with that.

    I guess my question is, can mortimer clarke still chase this old debt?

    I'm in a good place now, just really want to be left alone to get on with my life.

      problem is CCJ do not expire, sure somebody will advise you!

        Thanks for your reply.
        I understand a ccj doesn't expire, but what is allowed after six years?
        I thought the company had to go back to court, or something along those lines? To enforce the ccj?
        Really out of my depth here, i don't know what is going to happen next.
        any help would be appreciated

          To continue and enforce the CCJ they would need to get back to court and get permission, also generally have a very good excuse as to why no action within 6 years period?

          we all would like ti be left alone, but the vultures exist and whilst the government allow them to exist on persecution of the people then they will do so! very few regulations keep them in tact!

            So, can I take from that the chances of enforcement are slim?

            Do they often go back to court?

            Should I sell my stuff to pay them?

            Letters and resolvecall I can deal with, I think.

            Like a lot of people now, my mental health has taken a battering in recent times.

                      Once a creditor has a county court judgment (CCJ) for a debt, the Limitation Act does not put any time limits on how long they have to enforce that judgment. If your CCJ is more than six years old, and the creditor wants to use enforcement action, they must first get permission of the court.

                      And have a very good reason why inaction in all this time.
