Statute Barred In Two Months - Lowell and Capquest

  • Statute Barred In Two Months - Lowell and Capquest

    Hi guys,

    First time poster, long time lurker.

    I have debt with two creditors which will become statute barred in the first week of August, but I'm worried they may try and take me to court to issue a CCJ before the allotted 6 years is up. I haven't made any payments on these accounts since 2014 due to bouts of depression. I finally plucked up the courage to face my debts a week or so ago, but after speaking to both creditors (Lowell and Capquest) they inform me that both debts are still with themselves.

    I haven't at any point acknowledged the debt in writing or made a payment to any account since 2014. The two debts come to about 2k.

    My question is, what are they chances they may try and issue a CCJ in the next couple of months in an attempt to recover the whole debt? Is there any legal way I would be able to filibuster until then given these strange pandemic times?

    My sincerest apologies if I've put this in the wrong area.

      That could be the case. But if they haven't had payment in 6 years they may not have much joy through the courts either I guess.

        If they get to court before the 6 years is up then they may well succeed.

          From a legal standpoint though, how long does it take them to get a court date? Don't they legally have to send me a default notice before they send me any court documentation?

          So if they send me a default notice I could call them to set up a plan before it goes to court.

          I've just found out that the last payment on the account wasn't by myself either, it was by my partner and her name isn't on the credit agreement (credit card).

            They don't gave to get a court date, it is sufficient to have started proceedings and that can be done online almost instantly
