  • HSBC overdraft sold to Cabot Financial

    Good afternoon,
    I hope everyone is safe and well.
    I am looking for some advice if possible on an old overdraft debt with HSBC. It was recently sold to Cabot Financial.
    I believed the account was statute barred as i have not made a payment on the account since 2013.
    However, I have received a letter back from Cabot to say the account was terminated by HSBC in 2009 due to non-payment and arrears.
    They also enclosed a statement showing payments received odd months up until 2019.
    Having checked my old records it appears a utility company were paying me a small commission into the account some months without me realising.
    Does this mean the account isn't statute barred? Surely if the bank terminated my account they should not be accepting commission payments from a third party?
    I just wondered if there's anywhere i can go with this as I don't have the money to clear the account.
    Any advice would be greatly appreciated.

    It is statute barred you can either tell them it is statute barred under the statute limitations act 1980, get a subject acess request and make a complaint to the bank get interest charges and inconvenience caused back, contact cabot by writing and say it is statute barred over 6 years with no contact it is statute barred.

      I have sent them the statute barred letter and they replied with the above information and said due to payments until 2019 it is not statute barred.
      Should I just send the letter again and confirm it is statute barred even though a company was paying into my account?

        What I would do is contact the financial ombudsman service on 0800 0234567 make a complaint and get your subject acess request and ask why they have put all the charges in place?
