            Also, you mentioned Pkea, that these various debts need to appear in different threads that will better enable them to be processed? What do I need to do here? Sorry if I seem to be a pain. (it is only now that I'm trying to pull my head out of the sand and face up to all of this - but finding it very hard - no one else to talk to about it) Piesky

            No, its a bit of a long (sad) story but these debts actually relate to sole propriotor. The business was a limited company, but entered a creditors voluntary liquidation. I then purchased the stock and chattles, and continued to trade (but not as Ltd Co). A large part of the debts on the limited company were carried over because they were personally guaranteed.

              I would say out of all your debts, you need to sort your mortgage first.

                I am currently talking to the Mortgage company (Halifax at the moment) I have a lot of equity in the house (more than 50%) so their money is very very safe. They won't lose a penny, but we would lose alot if it is repossessed and sold at a cheap price.

                I was hoping to catch up on the arrears quite quickly but a person I've been working for has not paid the money that would have been used to do this. Quite a large amount.

                    No, this is what I'm talking to them about at the moment. I have also considered approaching a good friend about lending me the money (on a charge) to catch up.

                        By the way, the house is on the market at the moment as we could down-size and pay all debts. The only problem is that it is not a good time to sell with very few buyers looking at the property.

                        Yes, I am trying to get on top of things as far as the house is concerned. It is the other debts (creditors) that are putting pressure on me as well and at the moment, until I earn more money, I just can't do it.

                            Trying to get on top of the mortgage situation yes, but it is the pressure from all the other creditors that is making everything so very hard. We have our house on the market in order to down-size but that is not going to happen quickly. In the meantime, these other creditors continue to pressure and I am not earning enough money to pay. I am claiming working tax credits and even that is getting swallowed up at the bank.

                              It is usually the case that 'Those who shout loudest are those who are least entitled'

                              In other words they are making the debt you owe them seem the most important thing.

                              House, Tax, Utilities are the Priorities . Everything else goes in the pile

                                Hope someone can help with this. Of the CCA requests that I have sent off, only one has responded. I CCA'd DLRS - a DCA and I have today received a letter from HFC Banks. It reads as follows:

                                Dear piesky,

                                Thank you for you letter requesting for information in relation to the above account

                                Please find below account info relating to the account in accordance with section 77 of the consumer Credit Act 1974

                                Date opened - 2002
                                Payment Date - 4th of each month
                                Original loan amount 11,300
                                Monthly Instalment - £245.17
                                Last Payment date - May 2008
                                Current settlement figure - £2725
                                Loan Term 84 months
                                Loan Maturity date - April 2009
                                Account status - 1694 in arrears

                                Please find enclosed a statement of your account. This will list any payments received and charges incurred to-date.

                                HFC has been unable to provide a photocopy of the original agreement. However, please note that in accordance with regulation 3 of the Consumer Credit (Cancellation Notices and Copies of documents) Regulations 1983 we provide a copy of the executed agreement that does not include information which it is permitted to exclude such as the signature box.

                                Whilst monthly payments have not been maintained in line with the terms and conditions, the payments that have been received have been submitted by you and it is reasonable to conclude that you acknowledge this debt. In summary, our records confirm you have conducted the above account in a way that suggests you have a relationship with the bank.

                                I trust the information I have provided to you is to your satisfaction but should you require anything further, please do not hesitate to contact me, you can write to me care of the above address.

                                All HFC have supplied with this letter is a copy of the payments schedule and a standard, uncompleted, blank agreement on one sheet of A4 and terms and condition on another sheet.
