      Had a letter from Eversheds solicitors offering me a 35% discount on the outstanding debt if I pay by 4/2. Any thoughts on what I should do now?

            Finally got a response from Northern Rock after I sent them another letter asking for further info under my original SAR. They have basically wrote back to say that they have provided me with all the info they hold for me - They did send me alot of paperwork months ago but I cannot make head nor tail of - what should I do now?

              It's been quiet for months not heard from NR or there sols for ages, now out of the blue I've had a letter from there solicitor threatening court action again. My question is this, NR have either not bothered complying or are unable to send me all the required info regarding the first loan - which is where Curlyben thinks they have messed up on the settlement figure. My first thought is that as I have placed the account in dispute the solicitors shouldn't be hassling me in the first place, but as I have now sent them two letters explaining this, they don't seem to be giving in but at the same time, NR are saying they have provided all relevant info, when clearly they haven't. Any suggestions.....?

                CB dont know if you can remeber this its been such a long time. But got a letter at the weekend from NR saying they are closing my complaint as they have provided me with everything and that as far as they are concerned is it. To give you a brief rundown, I took out a loan in oct 05 but due to financial hardship tried to get the PPI canclled on it and reduced payments, it took months but they eventually cancelled it off & set up a new loan off their own backs that I never signed for. You asked me to try & get the closing balance off the old loan as you could not reconcile to new loan balance - therefore rendering entire agreement unenforceable.

                I attach agreements and closing balance of old loan - just wondering what to do now. Had various DCA's and solicitors chasing me, all of which gave up after a while, but will no doubt start up again now NR have 'closed their files'.

                NR were more than difficult in accepting a reduced payment offer so if it is unenforceable, Id be in a better position to negotiate on my terms rather than theirs. Thanks

                        You need to post the letters to get the right advice here. Anyone that directly threatens you with legal action should be a sent a CPR letter to demand disclosure, but its not clear if 1st Credit have actually done this. Presumably they are not claiming to own the account, in which case they couldn't take legal action anyway and are just trying it on, so the CPR letter should shut them up.

                        If you have not had full compliance with a SAR after the 40 days then you should complain to the ICO detailing what data they have failed to supply. You need to get this moving if people are threatening legal action.

                          Thanks for the reply, been offline for a while trying to sort personal problems. They have supplied the breakdown of the first loan which shows the closing balance, which is the 17019.55 but Curlyben has previously said that the the two amounts are incorrect (ie. the closing balance of the first loan and the opening balance of the new loan and therfore renders whole agreement unenforceable (copies attached in previous post). With the help of my husband am trying to sort the finances out but really all I can afford for this is £10 per month, should |I just continue paying this as if what Cb says is true they cannot enforce this debt?
