  • adc vs HFO??

    have received a default judgement £3,643.23 - original correspondence sent to former home which was reposessed 2 years ago, company making claim is hfo - never heard of them, i was made bankrupt in 2006, not had any credit or bank accounts since then - help!

    Hiya adc

    I've replied to your pm hun. But to summarise I think you should write to the solicitor advising that you have not received any correspondence from your old address since you moved. Also ask them who HFO are and what the debt is for.
    There are people on here that know more about bankruptcy and repossesion than I do and I'm sure that they will pop along in the fullness of time.
    Also we will get your post moved and will start a new thread for you.

          HFO are a major pain and will try all sorts of underhand tricks to get info
          ie using fake courier cards to get you to confirm your name and address etc.
          They tend to use electoral registers to guess at peoples addresses.

          DONT EVER CALL THEM OR GIVE THEM A CONTACT NUMBER

          or you will never here the last from them

                Ring the court and ask for the original POC, it may just have some dates in it. In any event the debt would have been included in your bankruptcy as you haven't taken any credit since I presume?
                You then need to start the process to get the judgement set aside on the grounds that it was a) sent to the wrong address and B) it is a debt included in BR, make a wasted costs claim as well.
