    I will draft something up for you later this evening and also dig out Rachel's email address / fax number so that you can get it through to her quickly.

    They are stupid expecting you to discontinue court claim before they have actually settled.

        Sorry by I couldn't resist the mention of the "paralegal". This is Rachel's position at Capital One. Just for reference, according to Wiki a paralegal is a person with legal training and/or knowledge who works under the direct supervision of a lawyer. Paralegals and legal document assistants (LDAs) are often mistaken for one another; however, in most jurisdictions, paralegals are not permitted to contract directly with consumers for the preparation of legal documents.

          Would it be an idea to add here something along the lines of .......

          I confirm that I will discontinue county court claim number xxxxxxxxxxx when, and only when, I have received the settlement payment and the monies have cleared in my account.

          Hope I'm not treading on toes here

                Cheq cleared & credit file looks fine, will send discontinuance notice off on Monday
