  • Kafka v Crap One

    This is a credit card account that was closed in 2004.

    Charges amount to almost £900 between 2001 and 2004.

    The claim being pursued includes contractual interest on all charges at 18.03%, a proveable rate in force at the time of the account closure.

    Unlike my previous MCOL claims, this one is being submitted through N1 to the local court in a few days time.

    they did that with me deller, I got their defence and cheque all in the same week!

      After a number of delays, the N1 was submitted today at the local court.

      Watch for developments.

        Just received a backlog of mail and caught up with this one.

        The claim was deemed served on 11 July.

        On 12 July Cap 1 sent an Acknowledgement of Service saying that they intend to defend the whole claim. The court filed the AofS on 16 July.

          Well well.........

          Despite the bravado, Crap One wrote on 20 July to say they were settling in full, only 11 days after Service. Usual crap about how I've been a naughty boy etc and how I have no case.

          Then the winner:
          "I would finally request that you contact the court to confirm the settlement and discontinue the claim. This is very important as it is your responsibility to inform the court that your claim is settled and avoid wasting any further valuable court time."

          Even though they've conceded, their main concern is not to waste the court's time. Doesn't this make all beagles want to buy their legal team a drink for their public spirit?

          OK OK - just thought I'd ask.

          This claim was kept within 6 years but I pulled the requested CI at 18.03%
          Next battles will be bloody ones against Yorks and NatWest going back 11 and 14 years respectively, using new POC.

                  I got the cheque today for the full amount less the interest since filing.

                  Just in time, because I got a summons from the Council yesterday for arrears of Council Tax, as they're demaning the full year's money that I can't pay them.

                  This probably means that I won't be able to replace the laptop either and unless I do this I could be without web access soon

                    Well done on getting your cheque.

                    Council Tax is a bummer, in a similar position myself, they can be quite reasonable if you make them an offer to pay so much a month....but in my case they've now got two attachment of earnings, due to start end of this month, 12% on each one. Am going to take a pay drop on my nett so i'll end up paying 7% on the second one instead of 12%. Naughty I know but necessary!

                      This will probably allow me to stave off the immediate issues, but then leave me short for other things I need to do like replacing the lappy.

                      However, the current pressures do provide me with clear evidence of hardship that I intend to use to fight any attempts to put stays on my 2 pending bank account claims. It will be interesting to see if a judge is still prepared to stay a claim that is in progress if this would mean legal problems for the claimant!

                        Dunno whether you should mention replacing the lappy to the judge though - he might not think its a priority

                        I have had no internet access at home since 11th June, but at least I can get on at work (when no-one's looking). That must be why I'm so far behind with work and my desk looks like Beirut on a bad day
