Well just this minute received a very bad copy of a Barclaycard Application, this is in respnse to my letter dated 31st MAY with my fee of £1.
An apology for the delay, but the person did not receive my request until the 6th July.
Now I would love to put this on here to show you, but to be honest when I have taken my sons details off it there is little much left pmsl.
I am however going to have a try, there is NO WAY this is a properly executed credit agreement.

Woa, can't see much, but I like the bar code right over the important bits, and I am pretty sure that says application at the top

It certainly does say Barclaycard Application at the top so I don't think we need to go any further.

It won't resize much coz it loses too much quality, needs scanning to be able to see it clearly or the photo taking at a higher resolution.

but its not properly executed in any case if it says application at the top and isnt signed by both parties at the very least! he could ask for the whole debt to be quashed in court because as we all know no CCA means they cannot enforce the debt unless they go to court and get the judge to say yes barclaycard i will enforce something that doesnt exist no problem!!!

that under bar marking is all about card protection, which is ticked I see.

Not a hope in hell is this an agreement? Not even a sniff of an APR or any interest rates at all. No terms and conditions or anything.

About the only thing it DOES say that supports its pretence to be an agreement is, it says it is. But that doesn't make it so.

However, I wish mine was like that. Then I might have been tempted to write back and say, OK then smart ar2e, if it's an agreement, then as it doesn't mention anything about interest rates, then you had no right to charge me any interest. So gimme it all back, you buncha crooks.

But the sensible thing to do really, is to tell them not to be silly, there isn't a judge in the land who would enforce a debt based on that piece of bog paper. Prescribed terms? What prescribed terms?

Do you think it would be worth emailing them and saying you have sent a copy of my application, have you got the agreement lol?

I wouldn't bother. It's obviously all they have, or they would have provided it by now.

I'd just email them and say, if this is all you have to offer, then BRING IT ON!!!!!
