    Letter from Barclaycard about Microveryfishy whatever 12th March:rolleyes:
    and statements post June 2004
    Prelim Letter 16th March
    Letter offering £120.00 30th March
    LBA 4th April
    Exact same letter and even dated 30th march came with same offer end April
    Rest of statements arrived 26th april
    Claim issued 30th April
    Acknowledged 8th May
    Schedule of charges sent to Northampton and Litigation and Disputes team Barclaycard 17th May
    Claim no 7QZ60811
    £352.00 plus £57.73 interest

    Also requested CCA and T&C's 31st May

          Update received standard (I hope) 13 point defence from barclaycard this morning. AQ dispensed with unless local judge orders it. More waiting eh hum!

                  Today received from Local cort:
                  Preliminary hearing, Special directions are needed in this claim to prepare for the final hearing which the judge would prefer to explain to you in person.
                  The Prelimininary hearing 14:00 24th August.
                  Ok pepps what is this and what must I expect? please

                    Enaid its nothing to worry about.It will be a bit like my phone conference. Can you give me a bit more info about the claim, is it pre 6 years, or post 6 years, and is it straight forward 8% or contractual interest. Dont panic hun, just give us a bit more info. Just gotta nip out for an hour, will be back shortly to answer questions once youve posted a bit more info on this one.

                      Tis a normal claim + 8% =£409.73 +£50.00 court fee.
                      They have paid him £120.00 back on his card, which I informed them would be taken off the total of the claim.

                        I requested CCA's and T&C's from Monument Cap! and barclaycard all on the same day. I have received Monument and Cap1.
                        Barclaycard have still not sent theirs, they received my letter on !st June, so giving them the 12 working days CCA was due on 19th June, then 30 calender days that gives them till 19th July. Have you got a letter for this or is it a court job? if they do not comply.
                        Do you think it will be any good throwing this at them in order to hurry the claim along, instead of all the court mallarky, any ideas anyone?

                          I personally dont think its anything to worry about Enaid. I think its like my two. The judge simply wants to speak to you regarding making you fully aware of what you might need, and also to see if youre aware of what directions would be needed. You could always try using that draft order for directions, like I did, submitted it to court together with attempting to get strike out of their defence by way of abuse order. I truly dont think you have anything to worry about. I think its more an informal chat to probs find the basics of the case. Everything on your claim seems standard, and youve followed everything correctly so I cannot imagine its anything bad. You could always try e mailing Barclaycard like I do, seeing if it kicks their butts into action prior to hearing. Is it a three way hearing, or does judge just want to see you. ???

                          Please dont worry Enaid. All sounds pretty standard to me, but you might want to familiarise yourself with a Draft Order for directions just in case judge asks your opinion on what direction you would advocate. Mine did. He asked what I would like for directions, as other side had said their bit, he wanted to give me opportunity to put my bit forward too, so I did. Just read up what it asks for in a draft order for directions. I can post you a copy up if you like or E mail them to you. But for a claim of this amount I just dont see how it can go wrong Enaid. Youve followed everything correctly so I think its a case of judge wanting to ensure you know what youre doing, and even perhaps to advise you of what you might need for the claim going forward. But I certainly wouldnt worry if I were you. All I can recommend is familiarise yourself with a draft order for directions, E mail me if you want to see a copy of mine that I used.

                              I don't think my son could do that Fendy lol it is his claim. I just have to make sure i get everything right, as it will be him before the judge and not me unfortunately.
                              I will have look at that letter if you don't mind Hod did mention a letter to throw out defence but I can't find it. Enaid and thanks x
