    Does anyone have any ideas on the best way to approach Capital One re this case?

    My daughter (she is a blonde) has only just realised that despite using her Cap 1 card within its limit and making minimum monthly repayments by DD, Cap 1 have charged her an overlimt fee of £12 per month for the last 3 months.

    After checking back through her statements I found that her statement dated 9th October stated she had the princely sum of £3.16 available to spend.

    On 1st November a DD payment of £24.84 was credited to her account.

    This should have left £28.00 available to spend. On 3rd November she paid £23.50 for petrol by her card, leaving £4.50 available credit.

    On 9th November CAP 1 debited purchase interest of £12.77 to the a/c, this threw the account into an overlimit situation by £8.27.

    On 24th November an overlimit fee of £12.00 was applied

    On 3rd December a "minimum" payment of £25.41 was taken by DD. This payment did not include the £8.27 overlimit amount or the £12.00 fee. The situation then began to snowball, because CAP 1 ignore any O/L amounts and fees when collecting minimum repayments.

    I think CAP 1 are deliberately providing misleading information because the summary box at the bottom of the statement says-
    minimum payment to have cleared into your account by 5th December = £33.68, yet the minimum payment they collected by DD was £25.41.

    The Statements says-
    "Do you want to make paying us hassle free?
    We can claim a direct debit each month for the minimum payment or for the full statement balance directly from your bank account to ensure your payment is received on time.
    No paperwork, no hassle."

    Hope this makes sense

    Sue them. It is the only thing Cap One understand. Do not try to engage them in any other form of communication. Call centre staff do not have any authority. Send them the Prelim, the LBA and then the N1. Your daughter will get this all back and Cap One do not usually close accounts either. There really is no other way.
