    History:

    Had a Cap one credit card 2001/2002 ended up the Buchanan Clark and Wells

    SAR sent to Cap One 12th july 2007 received 19th July 2007

    CCA request to Cap one 30th July 2007

    received letter they couldn't comply as the address was different to the one held by them (they had sent all the data for the SAR to this address) sent proof of address 10th August 2007

    Received copy of credit agreement (application form)


    Sent Prelim letter today asking for charges back

        No claim separately. £33 is £33 ...I have a claim with Barclays for £30 bet I will have to file in court to get it back! Muppets!

          Yeah thought it best to keep separate as I have one going with Littlewoods that I claimed both together and didn't seem to work.

          They refunded the PPI months ago just got a letter saying the have done an investigation and won't be refunding the payments so will have to look into that.

            I will make a wee bet with you that crap one will settle within a couple of week of you sending the prelim letter. They have with me on three occasions and still they have not closed the account.

                My accurate guess on this is they will offer you back anything above charge of £12 as per oft ruling etc. etc. etc. to start with. Pay no attention wse, ignore them, write back telling them you dont accept their offer, file at court and they pay out before 28 days defence is up.

                they first of all send acknowlegement saying they will defend, IGNORE IT.............................. continue onward and upward content in the knowledge once filed you are home and dry......................... honest. They pay out around 25 days after they have said they will defend and they have 28 days to file defence. They leave it till very last moment and ALWAYS, ALWAYS PAY OUT BEFORE IT GETS TO DEFENCE STAGE. Guaranteed.......................... chill, ur home and dry once filed....................... ha ha ha ha ha........................... take a chill pill and enjoy the ride.                       Great, so you know the answer to this already Scottishlash. Write back telling them thanks but no thanks, you consider it an insult and will only be happy with the full charges back, end of, or you are filing at court. Then dont negotiate anymore just file at court and before 28 days is up, you will have a letter and cheque for full amount. It wont even get to a hearing. Trust me on this.............................. you will get the full amount back. Just reject their offer. All the best. Nearly home and dry.

                        SL, don't accept it. Send a combined LBA/partial acceptance, or just a straightforward rejection. As they'll probably zap the offer straight onto your card if your account is still open, so watch out for that.
                        Then file at court, after you've had their next letter, which will be "this is our final offer, sod off". Once you've filed, they will acknowledge, and say they'll defend. But they never do. Just be careful that if they've put the partial refund onto your card, that they don't try and make out they've settled in full when they haven't, if you see what I mean. They will pay up within a few weeks.

                          They put a partial refund on my card and told me that was the best I was going to get, so I told them that I didn't accept it and filed at court (had done the nice please and the LBA), they acknowledged, said they were going to defend and then settled for the full amount.

                          They usually settle a couple of days after saying they are defending.

                          Stick to your guns, you will get it all

                            Thanks for all the help I will get on to this later today,going to reject their offer and send LBA.

                            The account is closed, must admit can't wait, could do with cheering up and nothing better than a nice cheque
