  • Bryan Carter response to CCA Request!!!

    Hi Guys!!

    i would be grateful of any advice here as i am unsure as to how to proceed.

    Bryan Carter have finally responded to my CCA Request for a Capital1 account. His response is basically a statement of transactions from an account. it does not have my name or signature on any documents so i cannot relate this to me in anyway as the account was from 2008.

    Is this compliant of my CCA Request or even a DSAR??? and if not, what should i do next???

    No signature is required.

    Name and address is though.

    What to do depends on what's happening really and you don't give much away.

      haha!!! youre right there!!! i do not give much away. thats because ive got a stutter and always try and keep communications minimalistic .

      here we go then:

      about six years ago i was in a lot of debt this was all in credit cards, overdrafts, unnecessary phone contracts, sky contracts, car finance, insurance. the kind of debt you dont realize youre in until you lose your job. my wife fell pregnant and we had our first baby . then sure enough i got made redundant :tinysmile_cry_t:. instead of trying to tackle the bills and contracts i was tied into, i stupidly ignored everything (maybe stress, depression, immaturity, or all three).

      our new family had to move in with my dad where we shared one small bedroom for all three of us, while i figured out how to fix things. i then came into a job where i could work as much as i wanted an earn as much as is reasonably practicable.

      i had two bin bags full of letters from creditors and DCAs. i worked through every letter i had and paid back everything that was claimed i owed, over the course of two years.

      my family and i were finally in a position were we could find our own place and start thinking about the future . this we did!!! we had another baby , we moved to a bigger house .

      and then letters from lowells started turning up :tinysmile_hmm_t2:. i ignored them at first, but then i remembered the problems we found ourselves in previously. so have tried to sort them out using the invaluable help on here.

      i do not know what debts i have paid or what debts i owe. but any documents i did have i repaid. now all of a sudden lowell are chasing me for four debts totaling around £4000.00. one is a credit card, one is an overdraft and two are for phone contracts.

      i have sent out CCA requests for all of them, and sent a DSAR for the overdraft.

      i have heard nothing from the CCA requests, apart from the credit card (which arrived today, from Bryan Carter). the documents he sent were just a statement from a capital1 account dating from 2007. all it had listed was transactions from an account and i am really unsure as to whether this is mine or not.

      finally, the DSAR i sent regarding the overdraft seemed to provoke lowells to include everything on the account (all four debts). the overdraft has been put on hold while they acquire the information from the bank. the phone contracts came back with just final bills and amounts i paid. and capital1 kind of showed me the same.

      i just want proof the the debts are mine, proof i havent repaid them and proof that they are not SB. but it does not matter what i do, it seems my requests are ignored.

      i havent got any secrets and im not ashamed of anything.

      just a bit upset that i cant sort this situation out myself:tinysmile_cry_t:

        It was your history i was after :tinysmile_twink_t2:

        It was the history of this matter e.g. how you acquired it in the bank, in a store, from a newspaper leaflet etc when, when was the last payment and that kind of stuff.

        It's quite likely that you should write back pointing out that they have failed to supply what they are required to under cca s78 and wait for a reply :tinysmile_twink_t2:
