    Due to renting a room on the rent a room scheme from April 1st I would be able to meet the higher amount. So my family helped me out and I have been paying the higher amount requested for 3 months now, each time writing asking for a formal payment plan. I have also written mid month every month. I have now received a letter saying even though I have paid the higher amount I have no plan so will still be defaulted after 6 months as not paying full amount.

    I have to ring them and go through all my financial details again to see if they will agree to a formal plan and they will not correspond further on the matter unless instructed by FSA.

    My quandry now is that I am back to square one and am banging my head against the wall. The stress of this has affected my ability to take on more work and caused worse financial hardship and I am in a vicious circle. They wont communicate still. I am reluctant to ring as last time I was subject to a 2 hour interrogation.

    Could somebody help me by telling me who I should be complaining to and what I need to send/tell them and what is the process please? I would be very grateful. Thank you.

        to be honest I just feel like jacking it in and not paying. I'm busting a gut to pay them and they're making it as difficult as possible. I'm just worried I'll end up losing my house.

          Of course, a valid concern!

          Why not log your complaints with the FOS & the ICO?

          Also, send in a further (short) letter of complaint to MBNA, mark your letter: ACCOUNT IN DISPUTE.

          MBNA, will not correspond with you but they have to abide by the FSA guidelines about complaints;
          MBNA will log the wordings in your letter.
          Therefore, keep you 'ACCOUNT IN DISPUTE' letter short and to the point.

            What are the implications of an account in dispute, please? Would I still be defaulted?

            Also I don't know what I need to do to complain to these organisations. Do I just send them copies of all correspondence to and from? I have every letter filed in order, with proofs of posting where appropriate.

              NO! you do not send the firm copies of all correspondence.
              Just, send a short and to the point "IN DISPUTE" letter stating your concerns; be brief but use your own careful words rather than using a template letter.

              Keep all the copy correspondence, to and from, for the ICO and FOS, as shown in the links below.

                  Hi Angry Cat thanks for the reply.

                  Am I right in thinking the unresolved disputes #16 means that they will probably default me anyway? I can't seem to get my head around what its saying.

                  Would my case come under ICO jurisdiction, as its not data protection? Should I also complain to OFT as they were the ones to chastise MBNA last year?

                        Thanks foe the link, but that link is taking me to info on details held by credit reference agencies which doesn't appear to be relevant to my situation. Should I be looking somewhere else on the website?

                          Drastic step I know, but I have not sent this months payment. After 6 months of trying to set up a formal payment plan, paying what they asked, and my letters ignored, and being stone walled at every stage, I feel I am wasting my time.

                          I have weighed up advice from other forumers and am going to write to MBNA saying the account is in dispute as they refuse to communicate with me, and send complaints to OFT, FSA, fos, and as angry cat advised, ICO, but am still a bit unsure of the relevance.

                          If anyone can think of any more I'd be grateful.

                            If you don't pay, they'll default you sooner, and take you to Court sooner. Simple, really. I suppose at least once you get to Court the judge will probably order an instalment plan which you can afford, so that's one good thing. Can't think of any more, though.
