  • MBNA Two Separate Notifications

    Hi all looking for some advice here if possible... must admit I'm beginning to get really worried now.

    I'm based in Scotland.

    issue 1

    Form 05 : Form of citation where time to pay direction may be applied for
    With attached form 03 (application for time to pay direction) and
    form 07 (notice of intention to defend)
    Citation was handed to me by my local postman which I had to sign for an had no idea what it was at the time of signing

    Received this a few days ago

    I've had two MBNA cards since 2006/07 all was well until 2009 when they credited the wrong card on more than three occasions with sums of over £300 each time. ( I was trying to pay off the higher of the two cards)

    The result was the amount of debt on the higher card was NOT being reduced as I had planned and I requested they write to me and advice why not.

    This went on for a few months and I maintained ABOVE minimum payments.

    I was then out of work for a period of time and looked at their PPI for support, turned out to be worthless so i cancelled this on both cards.

    I have constantly requested they provide recordings of telephone calls where the mix-up happened and they continuously failed to credit the right accounts when I made my telephone payments; they have yet to provide anything.

    I stopped paying anything towards both cards about four months ago

    I'm not sure what my next course of action should be now.


    Second issue: Received via mail today (no signature just post)

    (relating to above) is WARNING from a DRA acting on instruction from MBNA requesting full balance and dated 3/11

    Any assistance with either or both of these would be appreciated.

    I'm not in a position to pay (no steady income) my wife is now on permanent medication for high blood pressure following hospitalization due to the stress of all of the telephone calls and letters etc.

    Guess we are at the end of our tether with this and it's a run of misfortune that has got us in this pickle

    how about putting the account into dispute by trying to reclaim your ppi for starters,it sounds as it never paid out when you needed it to, it couid have been missold check pauls posts on reclaiming page 1.

        personally i,d call into your local cab with reference as to what to do next i don,t think the fsa will give advice on separate complaints for an individual, also fos will not give advice they will take on a complaint for you but will not advise you.

          the other guys will find your post here and might be able to advise you further,have you spoken to mbna and advised them that you will register a complaint with the financial ombudsman if they don,t at least try to unravel your account/s it sounds like it,s there mistake.

            So next steps...

            1) Contact local CAB

            2) Contact MBNA re the mix up and advise contacting FO

            3) PPI - follow pauls' advice


            Should I contact their appointed solicitor advising of my actions and also AIC their appointed agent in Scotland?

              i wouid take all those steps and see what comes of it, i,d definitley make the cab the first port of call though they will advise you in england of your right to have a free half an hour appointment with an inhouse cab solicitor i don,t know if scotland has the same i assume they do start there for the advice then if mbna will not play ball you can put a fos complaint in which shouid put the account in dispute, at that point mbna can take no action against you as the account is then in dispute.

                Hi folks, being a newbie here could anyone provide the links so I can read further and state my case?

                In particular:

                1) I want access to recordings and transcription going back to 2008 regarding these two MBNA accounts where on numerous occasions the payments I made were added to the wrong account and I was then subjected to additional charges and then threatening phone calls.

                These were large payments above the monthly minimum between £200 and £400.

                2) I want original copies of the original agreement for each account

                3) PPI claim... I believe that this was mis-sold and also they knew this when they added it to my account

                Any help greatly appreciated

                  Probably best to send s 78 requests for the agreements, statements of accounts etc and then follow this up with a SAR if they don't comply.
