  • Capital one Assistance required Please

    Hi Everybody,

    I am fairly new to this and hope some one can assist (I believe Budgie is the expert on Cap1 !!)
    I had a Cap 1 acct actually 2 for some unknown reason. anyway I wrote two letters with the card numbers asking for PPI repayment. on one account I got a holding letter saying they are investigation, but then I got another letter with a completley different acct number giving a settlement figure. I am attaching both letters as I am stumped as to what to do now any help would be appreciated.

    My Letter 1 was account ending 0062

    My Letter 2 was account ending 2010

    Yes you obviously did it correctly!

    Mods - can someone urgently remove the personal information. Although the poster has covered these up, they are still clearly visible under the stickers.

        If you're happy with the settlement offered on the one account I would accept it. The other they seem for some reason to be investigating, but state they will let you know what is happening, so I'm not quite sure why there is any confusion.

            Hey thanks Casper, the confusion is I sent two letters with the accounts numbers, but the offer came back with an entirely different account!! which Cap 1 state that they had closed I dont even know what was outstanding on that if there was any nor have I had any contact from Cap 1 or DCA chasing a debt from that account. Cap 1 states they sent me a DN never saw it and they claim there was a telephone conv, which I had called to say that I was out of work and personal problems.

            which is whyI am asking what to do, obviously I dont want to open a can of worms, but the same time if I owe them,( less any PPI or charges) I am willing to settle what I owe as I am back in gainful employment.

            Sorry I hadnt realised that pers info was showing thought I did a neat job cutting up stickers !!

              I would SAR them using a letter similar to the one below. They have 40 days to respond (days, not working days). At least then we'll know exactly where we stand. I am making the assumption that the letters you attached were from Capital and not a DCA. If it was a DCA just send a Prove It letter.

              5. Recordings of any telephone conversations, whether internal or external, relating to my account
              6. Copies of any e-mail's, or other electronic communications, whether internal or external, relating my account
              7. Copies of letters relating to my account
              8. All information relating to litigation that has taken place on my account
              9. A detailed statement of account showing a breakdown of all costs charged, showing in each case the reason for the cost and the actual cost against that item
              10. Copies of all reviews conducted relating to my account
              11. Any costs which relate to accounts held by myself.
              12. Copies of all relevant paperwork. I trust that the above is clear and should you be in any doubt as to your obligations as a Data Controller, then I would advise that you consult your corporate counsel.

              As detailed above, I have enclosed the statutory maximum fee of £10. You have 40 days in which to comply.

              If there is specific information which you require in order to satisfy yourself as to my identity, please let me know by return. However, please note that the above address is the one to which you have sent all previous correspondance to myself.

                    So mark in your diary - they have 12 days (+2 for posting time) by which to respond. Full stop. No excuses from them, apologies for delays or anything. They effectively have 14 days for you to receive the requested info from them. That makes it Monday 16th November in my book.

                      Hi Casper, I thought that if a SAR was sent then banks had 40 days to respond in your posting above you state 12 plus 2 days posting Have I barked up the wrong tree somewhere??

                          Doh!!!!! I blame it on me having a bad cold! Sorry for that.

                          40 days takes us to Sat 18th December. Keep us posted.
