Hi can anyone help show me the way to claim back my credit card charges even though i've been in an IVA? All help would be grateful thanks!

ok first off you need a list of all your charges, if you havent got thme then you will have to send a SAR (Subject Access Request) to the CC company.
then you need to do a spread sheet and then send off the first letter which is a prelim.

Thats great thanks. Can i just check again though, are you sure i can claim after an IVA? Rang a couple of the companys who claim on your behalf and they said any claim refunded would be paid towards any debt written off but as i satisfied the IVA i feel that would be unfair seen as it was all the heavy charges that pushed me towards meltdown in the first place!

If you are in any doubt then ring your IVA provider and ask them, I know if you are inan IVA the money would go towards your creditors but as your debt is now settled how can it?
If the bank/credit card company/lender you wish to reclaim unfair bank charges from is one of the ones in your IVA, then when a refund is due it will be used by them to reduce your debt with them. This means that you will not see any of the refund .
Also, the part of the debt that they will use your refund to pay, will be the part that you had originally been written off as a result of your IVA. So it would not even reduce your IVA payments.
It is only worth taking on a bank or credit card company if they are not one of the ones in your IVA, or the IVA has finished, or the total original amount owed to the company is less than the amount you expect to recover in unfair charges.Last edited by enaid; 18th March 2010, 04:28:AM.
