    My wife and I have recently recieved a notice of forced sale from a solicitors empolyed br arrow debt collecting agency, apparently on behalf of MBNA.
    My wife was coerced by them into making a promissary agreeement to pay.
    The MBNA account has to be in excess of six years as she had completely forgotten it ever existed and no contact had apparently been made.
    Any suggestions as to how to get this erased? Or how to deal with it?

    I don't quite get what you are saying, is there a charging order in place? If so to what does it relate?

      If you are absolutely sure there has been no contact for over six years then the debt is statute barred.

      You do not say what kind of debt this is. Also for them to go for a Charging Order and then to enforce it you must already have a CCJ against you for this debt. If you have no knowledge of this then you must contact the court to get details of the CCJ and apply for a Set Aside on the basis you had never received the Court papers. I suspect you may have left it too late for this.

      In order to get more help you must give more details.
