    Re: mbna sar sent

    Hi Nay

Umfortunately Cento tell everyone that they can claim back on unenforceable agreements whether it is true or not it is not a foregone conclusion, they do it so that you will think it a great idea and then pay to them an upfront fee- as yet not one person to my knowledge who has paid that upfront fee been successful in doing so and that has been since I have been monitoring this company since last March.

Why do you believe everything that they say is gospel?

    Tuttsi

I would follow the advice of peeps here who have far more knowledge with regards to these types of claims.

Getting worse, um! try to upload them minus usual details maybe we can see what is going on, if eventually if necessary go for Full Final Settlement, but long way off, as Wendy says maybe at the moment SAR them to see what charges are on there but request all information from 1996, may be these so called agreements were bought by MBNA who have not got them now??? These companies who ring you tell you all sorts with out factual evidence.

At this stage it doesn't matter whether they have the agreements or not. You can only use unenforceability as a defence, not as a basis for a county court claim. So until you get to the stage where you are defaulted and taken to court there's not much point in this angle, plus its a minefield.. And as I said earlier, it seems to me that you are trying to avoid the debt by getting it written off etc, which I personally wouldn't condone or recommend.

Nay, they are only "obliged" to send you 6 years worth of data. However, if they hold it then you should push for it.
