hello everyone ive just received my SAR from cap one added all the charges for late payment etc and i wish to claim it back,unfortunately i havent got the foggiest how to go about it,ive been reading through the other threads and it seems im going to have to issue them with court papers,fill in a spreadsheet and add the interest,if anyone could give me some advice how to start this i would be very grateful indeed,ie where can i download a spreadsheed and how do i worlk out the interest etc.Sorry to be a pain but these guys have been ripping me off for years,the charges they owe me is around 700 and my balance is only 600 so i think its time for revenge.

Have you actually sent a preliminary letter or LBA to Capital One yet asking for a refund of your charges together with compensatory interest?
If not then those will be the first steps to be undertaken before embarking upon court action.
If you need help with the preliminary letters or LBA then please just shout !!

I suggest we take things a step at a time girlsworld.
First step should be a preliminary letter asking for your charges to be refunded together with compensatory interest.
Next step ( assuming they do not rush to settle your claim ) is to send an LBA.
You say you are in the process of writing an LBA, does this mean you have already sent a preliminary letter? If so could you please post up a copy so we can see how it was phrased.
Also could you fill out a spreadsheet. A statutory interest version will be sufficient to start with. Once you have completed it them post it up or PM it to me to have a look at.
There is no need to include personal details that might personally identify you and I would suggest you do not include such details on any documents that you might post up on the forums, these are mainly public forums after all.
Will wait for your response before continuing. I have a couple of ideas ( new ones ) to try and squeeze an earlier settlement out of Capital One without having to resort to Court action. May be worth trying these ideas if you haven't already sent a preliminary letter. May still be possible to try these ideas even if you have sent a preliminary letter.

hi everyone i need some advice please,sent my prem letter to cap one on the 30/01/2010 received a reply back on the 10/02/2010 asking for a correct address which they obviously had as they posted the letter to the correct address in the first place,ive wrote back but not heard anything back since,so do i now send them a letter before action.

hello i need some advice regarding the cap one muppets,decided enough was enough and placed a claim with MCOL ,they acknowleged the claim on the 22/04/10 saying they are going to defend,low and behold i then receive a letter from F.T.C which i am assuming is an in house dept of crap one telling me i now have to pay the outstanding sum of 782.26 even though they owe my well over 1000.00 and today i receive another telling me i will be receiving a doorstep visit, is this the correct practice even though they know the account is going through the court system.

From experience Cap One normally pay out just before they have to defend. I think here that someone has given it to their debt collectors when there is court proceedings in place and they cannot do this.
When are they due to put in a defence?

They always say they will defend but never do. They usually cough up just before they are due to file their defence. In fact I am the only person I know who's ever had a defence from them, and that was pathetically woeful and they paid up in the next postman's visit lol. (Actually Budgie had a defence but he was going for compound interest which wasn't so straightforward, but he won anyway)
Did you claim for the total charges (not just over and above the £12). Did they make any offers before you filed at court?Is no longer here

they were served on the 22/04/10 and acknowleged the claim on the 26/4/10.i have claimed all the charges 12 and over,they have 28 days to submit their defence,think this is from the day they were served not really sure as this is the first time i have done anything like this.
