  • Credit card charges for Scottish customers

    I was just wondering if anyone knew the answer to this.....I read that if you live in Scotland you can only reclaim 5 years' worth of default charges on credit cards? (unlike those in England who can reclaim 6 years' worth).

    Does this mean just at a small claims Court, or does it also mean if I apply directly to the Bank for a refund?

    The Limitation period is 5 years in Scotland not 6. That normally applies generally to all causes of action, unless there are special circumstances.

      Aww..does that mean if I write to my Bank I can only ask for the last 5 years' worth of charges? Or do you think they will they let me have 6?

        Are you talking about bank account charges or credit card charges? They are two completely different things. Bank charges - not much chance at the moment until the new arguments and POCs etc following the OFT decision are sorted. Credit card charges - claimable as they are completely separate from bank account charges.

        Which credit card company is it?

          I'm only talking about credit card fees (late + overlimit fees). I know they're claimable, but can I claim only 5 years' worth (as I live in Scotland), or can I claim for all 6 years' worth?

          It's Royal Bank of Scotland (plus others, lol)

            If the limitations is 5 years then no doubt they will try to fob you off with 5 years. Have you actually started the process yet? It will be the credit card/card services arm of the bank. I claimed Natwest CC charges a couple of years ago without much trouble, as they are now part of RBS it may well be the same. You won't know till you try.
