          As Budgie says Cap - One's MO is to settle on issue of court papers in this way :All charges all purchase interest and statutory interest up until the date of their submission to the court plus your court fees. They say they will settle within 21 business days but are sometimes late.

          I think your claim may have "slipped through the net" with them as once they start the offer of settlement they tend to follow through regardless of Court stays etc.

          In some ways they cant wait to bring closure to the issue (Budgie!) as they are getting off light in terms of not paying CCI. It's your call.

          Be persistent & polite and I am sure Rachel will get back to you.

          The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

            Ammani is trying this email approach in advance of requesting a stay lift and possible resubmission of POC.

            I calculated charges + compound interest as opposed to charges + purchase interest + stat interest and there is about £100 difference. ( Compound being higher. So to avoid any further confusion I decided not to go into too many details about it in my earlier posts, also IMO there is no way Cap One would settle with compound at this stage.

            If this gets sorted via this approach Ammani will get her money quickly rather than in 6-9 months time and after numerous court appearances.

            If this approach doesn't work it's of course up to Ammani if she wishes to go the extra mile for an extra £100 or so that a resubmitted claim on the basis of compound interest would possibly generate.

              Hi there, sorry to keep you waiting ,on the news front, but had no reply from Rachel until yesterday. Apparently the court didnt serve my claim on Capital One. It looks like they decided to put the stays in effect, therefore saving them the hassle of sending out the claim forms! Which is annoying, considering you submit 3 copies to the court. Rachel has asked the court to send her a copy of the claim, and then she will get back to me, once she has looked at it. Hopefully the court has'nt lost the documents!

                  I cant believe that the court can get away with behaving like that, for the cost of a stamp !!

                  Any way your back on track hopefully!

                  I wonder how many more cases are stuck in limbo like that?

                    Hi again, no i didnt get any notification of service. I didnt even get notification of court claim number. Its only because i called the court to find out what was going on, that i was given the claim number! It would suggest that there are many claims, like this, having been put into court, but not actually been served! Not exactly how a court should behave, as far as i am concerned, considering they charge for a claim to be put in!

                        Have sent several emails to Rachel Howey, last being a few days ago, and no reply as of yet!

                        Explained i wanted to get this sorted asap, and if they didnt want an out of court settlement, to let me know, so i can contact the court, about removing the stay!

                        Will post up and more information, as soon as i recieve it.

                          I too have emailed Rachel nd keep getting a failed mail; I think she has either left so no longer has an emailaccount or something else is wrong! You could email Alan Swain as she us another member of that team at Cap One; I too willprobably do that.
