    Hi,

    I sent MBNA a CCA request letter and they havent replied within the twelve days so what should I do next??

      Wait and see.
      Once the 12 WORKING days has passed (Plus TWO further days for delivery etc) they are in default of your request and they cannot take any further action.

        Thanks Curlyben does that mean that I can now put my account into dispute with them using template letter or should i complain about their failure to reply to my request?

          While they are in default of your s77-79 CCA request the account IS in dispute and they CANNOT take any further action.

          Admittedly this doesn't stop them trying.

            Curlyben what do you mean by "any further action" and does that mean that I don't have to send a dispute letter and that I can / should stop making payments until they have satisfied my CCA request??

                Hi, Here is an update on what has been happening with my MBNA CCA request.

                I sent the CCA request on 11/11/09 via recorded delivery and got a reply from them on 5/12/09 which was 18 business days later.

                To date I havenot stated to them that I consider the account to be in dispute and last payment was made on 30/11/09 as I didn't want to stop paying before I knew where I stand legally.

                I have blanked out my name etc. Otherwise these are exactly what I received with no page numbers. All photocopies on A4 paper.

                MBNA 03 has my name and address printed above barcode area and my signature in sig box
                MBNA 04 printed on back of MBNA 03
                MBNA 05 has printed name & address - no sig or date
                MBNA 06 is 1st of 4 pages - has my name & address printed below lender details

                Would be grateful if someone more knowledgeable than me can give an opinion on whether it is

                1) an acceptable CCA request response
                2) It appears to be an enforceable CCA
                3) My options for further action or what I can do next

                  Hi people, It is comforting to know that Im not alone in this fight.
                  I sent of an agreement request on 8/12/09 and guess what? no response except phone calls from GVI. Admittedly I didnt sent the £1.00 fee, because I didnt know about that, but am I justified in starting to ramp up the level of formality on this, A new SAR is being drafted (work permitting) and will be sent off Monday 8/2/10.
                  Also how do I counter the flanking maneuver from GVI?

                  PS. GVI are demanding far more than MBNA, like six months out of date.
