  • BathTub vs Barclaycard

    Hello

    First a little context. Back in the spring my debt problems became unsustainable. I found sites like these to get hints and tips in a effort to bargin with my creditors, token payments that sort of thing. I noticed that it might be possible to claim back some money but I was so focused on getting them on side I thought it was pie in the sky and didnt really want to antagonise them. So I continued to try and get my creditors to understand my situation and help me out. However none of them would bite. It all came to a head when Mercers acting on behalf of Barclaycard sent a doorstep collector to my parents house where I am living demanding the full balance, which freaked me out somewhat!

    Fast forward a few months and things are very different. My family have been brilliant and have been helping me out, paying off two of the cards and and a bit off the third one. So mentally I am in a very different place!

    I recently S.A.R'ed all three of my creditors and BarclayCard were the first to reply with statements going back to october 2003 (If I remember rightly the account was opened in July/August of that year). Nothing else was included I might add. I was quite shocked to realise that I have a total of £460 of Late Payment/Overlimt charges, mostly dating from 03/04/05, so I was hoping claw some of that back! The Card itself was fully paid off in October 2009, thus the balance is Zero.

    So I thought that I would fire off a letter based on the template here. But I just wanted to ask about interest before I send it off. What should I be asking for? None? 8%? Higher? I have seen contractual rate mentioned in the template, is this the number that Barclaycard have been charging me? Or should I just let Barclaycard sort it as I have seen them with Tools and Angry&Informed.

    In the mean time I going to read a bit more of other peoples experiences and the guides here.

    Personally, I would try the Tools approach cos it may see that one dealt with quickly and allow you move onto the others.

      I would defintely send them a letter based on the Tools approach, but as you know how much your charges actually are amend it to reflect the actaul charges. Tools and I didn't know what the actual amount of charges were, we sort of winged it and were happy with what we ended up with. Inyour case, as you have an exact figure, ask for it, and add in a bit about relevant interest as well. There's a letter in my MBNA thread you could adapt as well.
      Barclaycard are quite quick so you should get a result fairly soon.

        Hi BathTub,

        I SARd them first and added the amount I thought due (£726) on the letter Tools put together, along with a demand for interest at the contractual rate.

        Enclosed with the letter I recieved from B/card informing me of the refund they were making I received a Schedule of Charges Document detailing the my unfair charges back to Oct '03 along with the interest they have refunded me.

        A £40 charge from Dec '03 has returned £39.38 refunded interest, apparently at 17.9% APR.

        More recently i paid a charge of £24 in March '07 for which i recieved a refund of £12.68, apparently at 24.4% APR.

        Anyone with a calculator and a bit more intellegence than me might be able to figure out if they've refunded that properly but it does seem to suggest that i received refunded interst 'at the contractual rate'. And that i've been paying a hell of a lot of interest on my balance (which incidently is now £0.00 )!

          Hi again

          Thanks for the replies.

          My first instinct was to just send the send letter too so I shall just do that with a list of charges rather than complicating things. It will go out first thing in the morning!

          Ill update this thread with any news.

          And thanks for the extra info Angry&Informed, very interesting. Hopefully ill get something along those lines too.

            Expect a refund very shortly and let us know how you get on.

            Glad my letter is helping so many people, gives me a warm feeling inside, however, that may be the Jack Daniels.

              A development, well sort of.

              I received a letter from Barclaycards Customer Relations Unit this morning thanking me 'for taking the time to contact us regarding the level of service blah blah, we aim to resolve matters before the 09 December 2009'

              No records will be broken here! I hope the other guys have better luck than me!

              So I guess I shall just have to sit on this for a while. Still, it gives me time to sort out the others!

                  Hmmm, do you think we've been publicising this Barclaycard pushover game a bit too much and they've got wise to the Beagle a.k.a Tools/Wends/Angry/Jax/and anyone else who can write approach????? We don'y have anyone called Barclaycardstaffmember registered do we?

                      Well its now 15th of December and despite being told that I was due a decision on my complaint by 9th of December I have heard nary a peep out of them. So I thought that I should get a 'Letter Before Action' out. I have been pointed in the direction of the Flangies vs. Capital One thread, its really interesting to see the whole thing played out and gives one confidence.

                      So I thought I would send out a second letter asking for the charges back with interest of 21.90% on each of those charges (My Current Purchase Rate) as well as the statutory 8% and include a list of charges in a spreadsheet. (Below)

                        Hiya

                        Dispite my message saying that I was going to send a second letter, Christmas got in the way and a jolly time was had by all.

                        The New Year arrived and I was suitably refreshed to chase this up. I sent a second letter and, after reading Nesta's result, I decided just to send a simple letter and leave it up to them to calculate the interest.

                        I sent that letter on the the 10th (Saturday). And today (12th) I received a letter from them dated the 8th, so before they received the second letter.

                        The result is that like Nesta they dont quibble the the 12 pound charge so all charges to be refunded! A total of £420. But because they took so long in replying they ignored an Oct 03 £20 and an Nov 03 £20, which is a bit cheeky considering I made my claim back in early November!

                        Also included is a total of £281.63 interest which means a total of 701.63. I checked my account online today and lo and behold it has been refunded to my account!

                        They also sent a Schedule of Charges Document detailing how they arrived at the interest. So a £20 charge back in O4 got 17.9% which was my contractual rate at the time and a £12 charge back in 07 received 24.4%, when my rate had been bumped up. A quick tap into the spreadsheets here, it would seem that these are simple rates as opposed to compound. I have attached a photo of the charge sheet for anybody who wants a peek. (Thats legal is it not?, Im not breaking any rules?)

                              Absolutely fantastic BathTub it took a while but at least they got there in the end.

                              A huge thanks for posting up the calculations they gave you and all credit to Barclaycard for supplying you with it.

                              As you have mentioned, it does seem they have refunded only simple CI, however, it is better than nothing and for very little legwork.

                              Well done again, not quite beat my 9 days but the challenge is still open to anyone and I would be very happy to lose the title.
