Hi, I have a citicard with a £15000 limit onit. However this was not the original amount when I took the card out, that was considerably lower. over the years I have received letters increasing the amount upto its current level. As i have not signed a new agreement is this unenforcible and can it be wiped out.
Is it unenforcible

Re: Is it unenforcible
Hi Flossylou and welcome to Legal Beagles.
Highly unlikley that you would be able to argue unenforcability on the grounds of your credit limit being increased.
Presumably the letters would have given you the option of declining to accept the increased limit and am pretty sure that the entitlment for them to increase your credit limit from time to time would have been covered in the original terms and conditions anyway.
Have you incurred any charges ( for late payment or over limit ) on the account?
I doubt if you have as otherwise they wouldn't have continually increased the limit as they have done.
Also, have you requested a copy of your original agreement from them so that you can check and see if it is CCA compliant.
You also don't say if you have actually spent up to you limit of £15,000 and / or whether you are simply checking the vailidity of the contract based on the continually increasing limit.
Are you having difficulty meeting the payments? Are they threatening legal action.
Please let us know a bit more information so that we can best see how we may assist you.
