  • Capital One update

Ok just wanted to let you all know about the latest happenings with regard to my long ongoing battle with Capital One.

I have been asking for a true signed copy of my CCA since Feb 09 to no avail, so I registered by complaint to the FOS. Today I received a letter from the FOS and enclosed in the letter was a signed credit agreement from Capital One!! They have therefore reached the decision that the agreement should be considered enforceable!

My battle with Capital One would now appear to be over and they have won, but I am now very confused as to why time limits and deadlines are there if they do not have to be adhered to and it would seem can not be enforced! Capital One had ample opportunity to supply me with my agreement and refused to do so but at the very last minute upon request of the FOS they have been able to supply the agreement, surely this is not acceptable or is it?

Can you scan and post this "agreement" ??

Remember the FOS do NOT get involved in enforceability issues.

If its the standard Cap 1 agreement then it's as much use as a chocolate fireguard as far as them being able to enforce it. Cap 1 don't seem to be able to produce an enforceable agreement - doesn't mean tho that they won't bug the hell out of you and then pass it to any DCA going!

I'm playing this game at the moment with them - so far 2 DCA's havecontacted me and both has passed it back to Cap 1.
