Just a quick update, Capital one have wrote to me to say they've sold this debt to Lowell's....
&....
lowells have wrote to me asking for the money.

the capital one default is reported until October 2014.

As far as I was concerned, this account was in dispute as my cca request dated 23/7/2009 was still unsatisfied.

is there anything I need to do regarding this in order to keep the stress to a minimum? The balance Lowell's are asking for is over £5000.

As If I am correct your agreement was same as mine it is Unenforceable also no Prescribed Terms at inception.,

Check Noddle as it may have gone off site as mine has now my actual Default letter date was in September, so something is happening, your last payment to SB?

My SB is next august as payment made up to 2009 august, so have to fight Lowell.

Yes you are correct! I have no idea when my last payments were. Probably around the cca request date but end of June 2009 as a guess!

It says in the capital one letter that Lowell's will start reporting on my credit file within 30 days so surely I need to tell them the account is in dispute before they do?
i don't want them on it for another 6 years!

I checked noddle & neither were showing at the moment....

Just an update - I did dispute it & lowells are investigating.
on my credit account it's appearing on equifax as lender unknown at the moment....it's only supposed to report until October 2014 so will check my report again at the end of Oct.
