    As i mentioned - i have refered this to the omburdsman - As there was no CCA produced, they should never have passed my details on to a DCA. I am awaiting the outcome and will advise.

      The FOS will not adjudicate on legal matters and will respond to that effect.

      You should write to the DCA and inform them that until they supply an valid executed agreement you do not wish to hear from them.

        Link Financial have now responded to my 'bemused' letter

        'Thank you for your letter dated xx. Please be aware your account was assigned to Link Financial on 23/4/09. We are only able to supply information relating to your account since it's assignment to ourselves. You will need to contact MBNA direct for information you require before this date. In order for us to supply you with your Subject Assess (can they spell?) details please send us the prescribed fee of £5 as outlined in the Data Protection Act 1998.'

        MBNA have banked my original £10 cheque and no SAR nor response to myCPR requests.

        I have never received a 'deed of assignment' from MBNA and have told Link this, but they persist.

        I soon move overseas and really would like this sorted once and for all. MBNA refuse to respond, Link send standard replies and quote an incorrect account number.

        Is court action the only way to get them to respond? If so do I send it to MBNA OR LINK.
        Alternatively I could propel them into action by claiming my chrges but as they won't respond to my SAR I cannot calculate them?

        Is this one of their tactics?
