    Hi Curly if you see this, sent cca to lloydstsb about my loan , they have sent back a fully enforceable agreement {well everything seems to be there} , was wondering if I should now do the following:

    My loan is from 2004 ,would have been fine till middle of 2006, when my debt problems started. have no ppi on it, but do you think Iwould have a case for trying to reclaim charges?
    If so which ones would be elligible for that?

    hope that makes sense, they havent sent a full statement of account only this months ,no history from the beginning of loan.

      Basically anything that isn't a normal payment is a charge, normally things like returned payment of DD charges as well as letters and misc collection.

      Remember on the whole loans are CCA compliant.

        yes ,just wanted to wake them up a bit ,they have been refrusing to recognise as I am incap benefit and on dmp with payplan , that I am paying what I can afford at the moment, so instead of just sitting here now ,Im at least going to try to knock off a few quid and at least will have gained something from them. next step SAR if they dont stump the records?

        On another point about B/card when they come back with statements and I have a go at reclaiming them, which will bring debt down to a fairly low 3 or 400 ish maybe lower . what sort of final offer might they take ? its been on going for about 30 months now and wondered if they might take 25% ish , just to get something off me?

          hi,
          B/card are now in default of my CCA.
          I was just going to ask , I am only paying a token ammount to them at the moment, should I definately stop this as they are in default ?, or just keep paying it? would paying it have any unseen consequences? re- the CCA default?

            Yes, once they have exceed the 12+2 WORKING days they cannot take further enforcement action until they comply.

                Just received from B/C ,the exact same responsethey sent the first time seemed to havejust changed the date.

                so they've had the cca time limit over -so defaulted
                sent a 2nd letter repeating their responsibilities and what I needed .
                so do I send a third or just ignore them as they have defaulted? or should I send a SAR as they have failed to supply my full statement of account ,so dont know what charges on account either?
